¿Robotización judicial? Breves reflexiones críticas

The profits associated to the AI applications are evident and, in fact, the solutions proposed by the technological advances search more efficiency and and efficacy in practically all of the spheres of human life. In this context, the political and legal reactions happens with more frequently, so they try to find a certain guaranty to those intimate human dimensions that could be seen damaged and threatened by the new “discoveries”. Reactions and responses that, necessary, must attends to the context and goals researched. In this sense, we wish call the attention, humbly, about the peculiarities of the legal phenomenon and, in particularly, about the AI applications in the legal field. From a philosophical perspective which treats the Law as something more than a simple ensemble of norms, is possible to analyze the potentials risks of the computer advances applies to the legality. If few years ago it’s amazed with enthusiasm the improvements addressed by the legal computing, today they are observed with concern those attempts that aim to extend the great advances technological to the field of legal decisions. Without despise the great goals reached by the robotics phenomenon, is our intention walk with the reader towards one model of reasoning prudent, flexible and dynamic, one model that can show a high consideration for the empirical and axiological levels of the legal reality in correspondence to the innovative chances.
